სუბსიდიარობის პრინციპი და მისი იმპლემენტაციის პერსპექტივები ქართულ პოლიტიკურ-სამართლებრივ სივრცეში

როგორც ამბობენ, კანონმდებლობაში სამი სიტყვის ცვლილებამ შეიძლება მთელი ბიბლიოთეკები მაკულატურად აქციოს, თუმცა, სამი ახალი სიტყვა და ბიბლიოთეკები ხელახლა შეივსება. სუბსიდიარობის პრინციპი სწორედ ამ უკანასკნელ კატეგორიას მიეკუთვნება.[1]თანამედროვე პერიოდში სუბისიდიარობის პრინციპი ერთგვარ „მოდურ“ იდეად იქცა. ის ბევრი ევროპული სახელმწიფოს პოლიტიკურ-სამართლებრივი ტრადიციების შემადგენელი კონცეფციაა.[2] მან აღიარება და გავლენა აშშ-იც მოიპოვა.[3] უფრო მეტიც, სუბსიდიარობის პრინციპმა ასახვა ევროკავშირის შეთანხმებაშიც ჰპოვა.
2017 წლის საკონსტიტუციო რეფორმის შედეგად პრინციპი საქართველოს კონსტიტუციაშიც დამკვიდრდა. ამდენად, მან საქართველოსთვის დამატებითი აქტუალურობა შეიძინა. წარმოდგენილ ნაშრომში განხილული იქნება სუბსიდიარობის პრინციპის ძირითადი კონცეფცია, პრინციპის შეფარდების პირობები და კონსტიტუციური რეგლამენტაციის პრაქტიკა, აგრეთვე შეფასებულ იქნება საქართველოში სუბსიდიარსობის პრინციპის იმპლემენტაციის გამოწვევები და მისი შეფარდების შემდგომი პერსპექტივა.
