წინამდებარე სტატია მიმოიხილავს ადმინისტრაციული და სამოქალაქო საპროცესო სამართალწარმოებათა ურთიერთგამიჯვნის პრინციპულ ასპექტებს, ასევე დღეს არსებულ რეალობას სასამართლო პრაქტიკის ანალიზის სახით. კვლევის ინსპირაციის წყარო გახდა საერთო სასამართლოების მიერ საქმეთა განხილვისას ინდივიდუალური ადმინისტრაციულ-სამართლებრივი აქტების მოქმედების შეჩერებით გამოწვეული ზიანის უზრუნველყოფის მიზანშეწონილობის შესახებ საკითხის აქტუალობა.
კვლევა შესრულდა შედარებით-სამართლებრივი მეთოდის გამოყენებით, ასევე საქართველოს საერთო სასამართლოებისა და საკონსტიტუციო სასამართლოს პრაქტიკის განზოგადების საფუძველზე. სტატიის არსებითი ნაწილი ეთმობა ადმინისტრაციულ სამართალწარმოებაში სარჩელის უზრუნველყოფის ღონისძიების სახით აქტის მოქმედების შეჩერებით გამოწვეული ზიანის ანაზღაურების უზრუნველყოფის დაშვება/დაუშვებლობის პრობლემურ ასპექტებს ადმინისტრაციულ დავაში კერძო პირთა ინტერესების შეპირისპირებისას.
შედარებით-სამართლებრივი კუთხით სტატიაში გამოკვლეულია ადმინისტრაციული მართლმსაჯულების განხორციელებისას ადმინისტრაციულ-სამართლებრივი აქტის მოქმედების შეჩერების შემთხვევაში ზიანის უზრუნველყოფის საკითხის ნორმატიული მოწესრიგება და დოქტრინაში დამკვიდრებული შეხედულებები გერმანიის, საფრანგეთის, ლატვიის, ესტონეთის და ამერიკის შეერთებული შტატების მაგალითებზე.
მართლმსაჯულების ეფექტურობა დამოუკიდებელ, მიუკერძოებელ, სამართლიან და დროულ სამართალწარმოებაში ჰპოვებს თავის გამოხატულებას. [1]
