საქართველოს 2015 წლის 27 ოქტომბრის საჯარო სამსახურის შესახებ კანონმა, რომელიც ძალაში შევიდა 2017 წლის 1 ივლისიდან, განამტკიცა მერიტოკრატიულ პრინციპზე დაფუძნებული საჯარო სამსახური, სადაც განსაკუთრებული ადგილი უკავია საჯარო მოხელის სტაბილურობას და მისი კარიერული განვითარების უწყვეტობას. კანონის მიზანი, უზრუნველყოს კარიერულ წინსვლაზე, დამსახურებაზე, კეთილსინდისიერებაზე, პოლიტიკურ ნეიტრალიტეტზე, მიუკერძოებლობასა და ანგარიშვალდებულებაზე დაფუძნებული, სტაბილური საჯარო სამსახურის ჩამოყალიბებისა და ფუნქციონირების სამართლებრივი საფუძვლების შექმნა, განსაკუთრებით აქტუალური ხდება რეორგანიზაციის პროცესში, მით უფრო, თუ მას მოყვება შტატების შემცირება. კანონი ითვალისწინებს შტატების შემცირების გამო მოხელის გათავისუფლებას, რაც საკმაოდ პრობლემატური და მტკივნეული საკითხია. სტატიაში განხილულია რეორგანიზაციის პროცესში საჯარო დაწესებულების როლი და პასუხისმგებლობა, ასევე მიღებულ გადაწყვეტილებაზე სასამართლო კონტროლის განხორციელების ფარგლები. კვლევაში განსაკუთრებული ყურადღება ეთმობა მობილობის ინსტიტუტს, რომელიც მთავარი საფუძველია რეორგანიზაციის პროცესის უმტკივნეულოდ, ნაკლები პროფესიული დანაკარგით წარმართვისათვის და წარმოადგენს მოხელის დაცვის გარანტიას ამ რთულ პროცესში.
