„საქართველოსა და ამერიკის შეერთებულ შტატებს შორის ექსტრადიციის შესახებ ხელშეკრულება (შემდგომში - „ხელშეკრულება“)[1] უმნიშვნელოვანესი სამართლებრივ აქტია, რომელიც ექსტრადიციის პროცესის დარეგულირებას და სამართლებრივი თანამშრომლობის გაღრმავებას ისახავს მიზნად. სტატია გააანალიზებს ხელშეკრულების არსებით ასპექტებს, მათ შორის - ხელშემკვრელი სახელმწიფოების მიერ საკუთარი მოქალაქეების ექსტრადიციის შესაძლებლობას, ადამიანის უფლებების დაცვის მექანიზმებს და ექსტრადიციის პროცესში სასამართლო ინსტიტუტების როლს.
სტატიაში წარმოჩინებულია ხელშეკრულების მეშვეობით სისხლის სამართლის პროცესში საერთაშორისო თანამშრომლობისას საქართველოს შესაძლებლობების გაძლიერება, განსაკუთრებით - აშშ-დან კონკრეტული პირების გადმოცემის პროცესში. აქვე დეტალურადაა განხილული ის გამოწვევები, რომლებიც უკავშირდება ხელშეკრულების საქართველოს საკანონმდებლო ჩარჩოსთან და საერთაშორისო ვალდებულებებთან შესაბამისობას. სტატია ყურადღებას ამახვილებს საკუთარი მოქალაქეების ექსტრადიციაზე; ეს სიახლე, ხელშეკრულების ამოქმედების კვალდაკვალ, არსებითი ცვლილებაა სამართლებრივ ჩარჩოში.
წინამდებარე სტატიაში ხელშეკრულებით შემოთავაზებული კიდევ ერთი მნიშვნელოვანი სიახლეა განხილული: ექსტრადიცია დანაშაულისთვის, რომელიც სასჯელის სახით სიკვდილით დასჯას, მისი არაღსრულების გარანტიით, ითვალისწინებს. სტატიაში ასევე განხილულია სასამართლო პროცესების როლი და მტკიცებულებების წარდგენის სტანდარტი ექსტრადიციის საქმეებში, ისევე როგორც, ის სირთულეები, რომლებიც შესაძლოა წარმოიშვას სხვადასხვა სამართლებრივი სისტემების ურთიერთქმედებისას.
