დისციპლინური წარმოებისა და მხილების განცხადებასთან დაკავშირებული ადმინისტრაციული წარმოების გამიჯვნის პრობლემატიკა

მხილების მომწესრიგებელი ნორმები ქართულ სამართლებრივ სივრცეში 2009 წლიდან გაჩნდა[1] და მასთან დაკავშირებულმა საკანონმდებლო ჩარჩომ დღემდე არაერთი ცვლილება განიცადა. მიუხედავად ამისა, კვლავ რჩება მისი იმპლემენტაციის პრაქტიკული გამოწვევები. მთავარ სირთულეს წარმოადგენს დისციპლინური წარმოებისა და მხილების განცხადებასთან დაკავშირებული ადმინისტრაციული წარმოების ერთმანეთისაგან გამიჯვნა. პროცედურული ბუნდოვანება აყალიბებს არაერთგვაროვან ადმინისტრაციულ პრაქტიკას, რაც მხილების მექანიზმის ფუნქციონირებასა და ზოგადად, საჯარო მმართველობის განხორციელების პროცესზე უარყოფითად აისახება.
