ანოტაცია

საქართველოს საკონსტიტუციო სასამართლო გაზრდილი მიმართვიანობის კვალდაკვალ დგას იმ გამოწვევის წინაშე, რომ არ გადაიტვირთოს უსაფუძვლო და იმავდროულად დაუსაბუთებელი კონსტიტუციური სარჩელებითა და წარდგინებებით. მნიშვნელოვანია სასამართლომ არსებითად განსახილველად მიიღოს სწორედ ის საკითხები, რომლებიც ექცევიან მისთვის კონსტიტუციით განსაზღვრულ უფლებამოსილებათა არსენალში და ემსახურებიან დარღვეული უფლების აღდგენას, ასევე უფლების დარღვევის პრევენციას. ვინაიდან, თითოეული კონსტიტუციური სარჩელის არსებითად განხილვა უკავშირდება შეზღუდულ ადამიანურ და მატერიალურ რესურსებს, მხოლოდ მათი რაციონალური გამოყენებით შეიძლება საკონსტიტუციო სასამართლოს მანდატის სრულყოფილად განხორციელება.

სტატია ეძღვნება სწორედ იმ თეორიული და პრაქტიკული პრობლემების კომპლექსურ და შედარებით ანალიზს, რომლებიც წარმოიშობიან კონსტიტუციური სარჩელების არსებითად განსახილველად მიღების საკითხის გადაწყვეტისას, კერძოდ დასაბუთებულობის მოთხოვნის ჭრილში. ნაშრომში ასევე იქნება განხილული ზემოხსენებულ სფეროში კანონმდებლობის სრულყოფისა და ერთგვაროვანი სასამართლო პრაქტიკის ჩამოყალიბებისათვის კონკრეტული რეკომენდაციები.
