საერთაშორისო აქტების სიმრავლის, ეროვნული კანონმდებლობის საერთაშორისო სტანდარტებთან ჰარმონიზაციის, დაზარალებულთა და მსხვერპლთა დაცვის არაერთი მექანიზმის, დანაშაულის პრევენციის და დამნაშავეთა რესოციალიზაციის პროგრამების ხელმისაწვდობის, ცნობიერების ამაღლების კამპანიების და საკითხისადმი საზოგადოების დამოკიდებულების არსებითი ცვლილების, შემაკავებელი ორდერების ფართოდ გამოყენების, სამართალდამცავი ორგანოებისადმი მსხვერპლთა მიმართვიანობის და გამამატყუნებელი განაჩენების რაოდენობის მნიშვნელოვანი ზრდის[1] მიუხედავად კვლავაც გამოწვევად რჩება აღნიშნული კატეგორიის საქმეებზე მართლმსაჯულების განხორციელება, რაც უკავშირდება ან დაზარალებულის შეცვლილ პოზიციას საქმის სასამართლოში განხილვისას ან, დანაშაულის ხასიათიდან გამომდინარე, მტკიცებულებათა არასაკმარისობას გამამტყუნებელი განაჩენის დასადგენად დაზარალებულის მამხილებელი ჩვენების მიუხედავად.
[1] 2023 წლის განმავლობაში ოჯახური დანაშაულისთვის გასამართლდა 2928 პირი, საიდანაც ოჯახში ძალადობისთვის - 1413. აქედან, გამართლდა შესაბამისად - 427 და 228 პირი; ხოლო 988 და 438 პირის მიმართ ( შესაბამისად) გამოყენებული იქნა თავისუფლების აღკვეთა. 2022 წელს ოჯახში ძალადობის და ოჯახური დანაშაულისთვის მსჯავრი დაედო 2375 პირს, ხოლო 420 პირი გამართლდა.
