მოხელის გათავისუფლება პირადი განცხადების საფუძველზე წარმოადგენს გათავისუფლების დისკრეციულ (არასავალდებულო) საფუძველს, რაც უკავშირდება ერთის მხრივ პირის უფლებას -უარი თქვას სამსახურზე და მეორეს მხრივ საჯარო დაწესებულების ვალდებულებას, დაემორჩილოს პირის არჩევანს. სტატიაში განხილულია საკითხები, რომლებიც თან ახლავს ამ საფუძვლით მოხელის გათავისუფლებას. გამოკვეთილია მოხელის ნების თავისუფლების მნიშვნელობა, საჯარო სამსახურის ინტერესის დაცვის მიზანი, პირადი განცხადებით გათავისუფლების უფლების შეზღუდვა, სასამართლო პრაქტიკა.
