ანოტაცია

ერთი და იგივე სამართლებრივი პრობლემა, როგორც წესი, განსხვავებულად არის ხოლმე მოწესრიგებული სხვადასხვა მართლწესრიგში, თუმცა მიუხედავად ამისა, მთელ რიგ საკითხებში მაინც შესაძლებელია საერთო შეხების წერტილის პოვნა, რისი შედარებით-სამართლებრივი ანალიზიც გვეხმარება იმის დადგენაში თუ როგორი მოწესრიგება შეიძლება წარმოადგენდეს ეროვნული სამართლისთვის ყველაზე შესაფერისს. ერთ-ერთ ასეთი საკითხია „ცოდნის“ პრობლემატიკა უძრავი ნივთების კეთილსინდისიერი შეძენის სამართალში, რომელიც წინამდებარე სტატიაში ქართული, გერმანული და ინგლისური სამართლის მაგალითზეა განხილული. მიუხედავად იმისა, რომ ეს ქვეყნები თავად საკუთრების უფლების გაგების თვალსაზრისითაც კი განსხვავდებიან ერთმანეთისაგან (იგულისხმება განსხვავება ინგლისურ სამართალთან მიმართებით), უძრავ ნივთზე უფლების კეთილსინდისიერი შეძენის შეფასების ნაწილში „ცოდნა“ სამივე მათგანში გადამწყვეტი მნიშვნელობისაა. ამდენად, „ცოდნის“ კომპონენტის კომპარატივისტული კვლევა ღირებული დასკვნების გაკეთების შესაძლებლობას იძლევა.
