სტატია ეძღვნება ვალდებულების შესრულების გართულების ინსტიტუტის დამაფუძნებელი მატერიალურსამართლებრივი წინაპირობების შედარებითსამართლებრივ ანალიზს უნიფიცირებული სახელშეკრულებო სამართლის ინსტრუმენტების, ანგლო-ამერიკული და უმთავრესად, კონტინენტური სამართლის ცალკეული ქვეყნის რეფორმირებული მართლწესრიგის კვლევის საფუძველზე. ვალდებულების შესრულების გართულების მაკვალიფიცირებელი სამართლებრივი მახასიათებლების ანალიზი ხორციელდება ფორსმაჟორის კონცეფციის სამართლებრივ ბუნებასთან ურთიერთკავშირში, რითაც მიიღწევა ამ ორი პარადიგმის განმასხვავებელი არსობრივი ნიშნების წარმოჩენა თანმდევი სამართლებრივი შედეგებისა და პასუხისმგებლობის ფარგლების, სახელშეკრულებო რისკის სფეროების განსაზღვრის მიზნით. კვლევის არსებითი ნაწილი ასევე მიმოიხილვას სასამართლოს ლეგიტიმური ინტერვენციისა და მხარეთა ნების ავტონომიის დაცვის ფარგლებს, სასამართლო კონტროლის განხორციელებისას გამოსაყენებელ მეთოდებს, გასათვალისწინებელ ობიექტურ კრიტერიუმებს შესრულების სიმძიმის ხარისხის მიხედვით ხელშეკრულების ადაპტაციისა თუ მისი შეწყვეტის პროცესში.
კვლევის აქტუალობა განსაკუთრებით იზრდება covid-19 პანდემიის გავლენით გართულებულ სახელშეკრულებო ვალდებულებათა შესრულების ფარგლების განსაზღვრისა და ამ სფეროში ერთგვაროვანი ქართული სამოსამართლეო პრაქტიკის ჩამოყალიბების მიზნებისთვის.
