ექსტრადიცია ადამიანის უფლებათა ევროპული კონვენციის მე-3 და მე-6 მუხლების ჭრილში: საქართველოს წინაშე არსებული გამოწვევები

სისხლის სამართლის სფეროში საქართველოს საერთაშორისო თანამშრომლობის კონტექსტში, ექსტრადიციის პროცესში მნიშვნელოვანია ევროპის საბჭოს სტანდარტების დაცვა. შესაბამისად, ადამიანის უფლებათა ევროპული კონვენციის[1](შემდგომში – ევროპული კონვენცია) ცალკეული მუხლების ანალიზს, როგორც აკადემიური, ისე პრაქტიკული მნიშვნელობა აქვს. წინამდებარე კვლევის მიზანია, ექსტრადიციის პროცესში ევროპული კონვენციის მე-3 და მე-6 მუხლების დაცვის სტანდარტების ანალიზი და მათი განხორციელების ხარისხის შეფასება საქართველოს პრაქტიკის მაგალითზე. სტატიაში გაანალიზებულია, რამდენად ეფექტიანად აფასებს საქართველოს სასამართლო და აღმასრულებელი ხელისუფლება რეალურ რისკებს ექსტრადიციის საქმეებში და რამდენად უზრუნველყოფილია ინდივიდის ფუნდამენტური უფლებების დაცვა.
ექსტრადიციის პროცესში ადამიანის უფლებათა დაცვის საკითხი განსაკუთრებით აქტუალურია საქართველოში, სადაც პრაქტიკა აჩვენებს სამართლებრივი სტანდარტების ფორმალურ, მაგრამ არა ყოველთვის ეფექტიან აღსრულებას. კვლევა ამ პრობლემას განიხილავს როგორც საქართველოს შიდა სამართლებრივ სისტემაში არსებულ სუსტ რგოლს და საერთაშორისო პასუხისმგებლობის პოტენციურ წყაროს. სტატიაში განხილულია ექსტრადიციის დროს ადამიანის უფლებათა დაცვის საკითხებთან მიმართებით საქართველოში კვლავ არსებული გამოწვევები და შემოთავაზებულია მათი გადაჭრის გზები.
