საადგილმამულო მეურნეობის საერთო ქონებაზე სამკვიდროს გახსნა

საქართველოს სამოქალაქო კოდექსში, კომლთან დაკავშირებული საკანონმდებლო ცვლილების შემდეგ, რთულად თუ მოიძებნება მუხლი, რომელიც კომლის ქონებაზე სამკვიდროს გახსნას და მემკვიდრეობის მიღებას სრულყოფილად მოაწესრიგებს. სტატიის სათაურში გამოყენებული - საადგილმამულო მეურნეობა, სამოქალაქო კოდექსში უკვე ჩანაცვლდა - საოჯახო მეურნეობით, თუმცა ამ ცვლილებას არ ჰქონდა გამართლება, გარდა კომლის მემკვიდრეთა უფლებების სელექციისა და დაკნინებისა. შესაბამისად, საკითხის ყოველმხრივ გასააზრებლად, მიზანშეწონილია ნაშრომის სათაურში საადგილმამულო მეურნეობის გამოყენება. საკუთრების უფლების რეგისტრაციისას საჯარო რეესტრი უფრო მეტად უნდა ჩაუღრმავდეს საადგილმამულო მეურნეობაში სამემკვიდრეო ურთიერთობებს, რადგან საკომლო საკუთრებაზე უფლების დამდგენი დოკუმენტების მოუწესრიგებლობა კითხვის ნიშნის ქვეშ აყენებს კომლის მემკვიდრეთა უფლებებს, სამოქალაქო ბრუნვის სტაბილურობას და აფართოებს მოქალაქეთა დაუსაბუთებელი მოთხოვნების წარმოდგენის ფარგლებს. კვლევის ამოცანაა, ნათლად წარმოაჩინოს სამემკვიდრეო ურთიერთობის სირთულე კომლში და შეცდომები, რომლებიც არ უნდა დაუშვას საჯარო რეესტრმა.
