ნაშრომი ეხება თანამედროვეობის ერთ-ერთ პრობლემურ და აქტუალურ საკითხს. მიუხედავად, იმისა, რომ უახლოესი ათწლეულების განმავლობაში არაერთი საერთაშორისო, თუ შიდასახელმწიფოებრივი ინსტრუმენტის[1] გამოყენებით მიმდინარეობს ორგანიზებული, მათ შორის ტრანსნაციონალური ორგანიზებული დანაშაულის წინააღმდეგ ბრძოლა, ის სულ უფრო მასშტაბურ და გლობალურ ხასიათს იძენს. „საერთაშორისო სავალუტო ფონდის” ინფორმაციით, ნარკოტიკებით ვაჭრობიდან და უკანონო შემოსავლის ლეგალიზაციიდან მიღებული შემოსავალი, მსოფლიო ეკონომიკის ექვსიდან რვა პროცენტს უტოლდება.[2] ამდენად, ამ ფენომენის წინააღმდეგ ბრძოლა მუდმივად განახლებულ გააზრებას საჭიროებს.
ციფრული ტექნოლოგიების მზარდი გამოყენება, როგორც საჯარო, ისე კერძო სექტორში, დამნაშავეთა სამყაროსთვის ახალ მოტივაციად იქცა, რათა გაადვილდეს ისეთი დანაშაულების ჩადენა, რომელთაც შეუძლიათ განუზომლად დიდი ეკონომიკური ზიანის მოტანა საზოგადოებისათვის. ტრანსნაციონალური ორგანიზებული დანაშაულის წამყვანი მამოძრავებელი ფაქტორი მოკლე დროში მაქსიმალური მოგების მიღებაა. ამ კომპლექსური კრიმინალური მოვლენის წინააღმდეგ ეფექტური ბრძოლა დანაშაულებრივი გზით შეძენილი ქონების მოძიებასა და კონფისკაციაზე გადის.[3]
სტატია დაფუძნებულია დოქტრინისა და სასამართლო პრაქტიკის ანალიზზე. კვლევაში განხილული იქნება ტრანსნაციონალური ორგანიზებული დანაშაულის წინააღმდეგ ბრძოლისას დანაშაულებრივი ქონების დაბრუნებასთან დაკავშირებული ცალკეული ასპექტები და თანამედროვე გამოწვევები.
კვლევის მიზანია კვლევის საკითხთან დაკავშირებული ხარვეზების იდენტიფიცირება და მათი გადაჭრის უზრუნველსაყოფად გასატარებელ ღონისძიებათა განსაზღვრა.
