მეუღლეთა შორის სამართლებრივი ურთიერთობების მომწესრიგებელი ნორმები ანტიკური ეპოქიდან მოყოლებული ცივილიზებული სახელმწიფოების მონაპოვრად მიიჩნევა. მსოფლიოს თანამედროვე სამართლებრივ სისტემებში მეუღლეთა ქონებრივი ურთიერთობების მოსაწესრიგებლად არაერთი პრინციპი და რეჟიმი იქნა შემუშავებული. შესაბამისად, ქართული საოჯახო სამართლისათვის, როგორც ერთ-ერთი ახალგაზრდა სისტემისათვის, აუცილებელია შედარებითისამართლებრივი მეთოდის გამოყენების გზით შესწავლილ იქნეს მოწინავე იურისდიქციების მქონე სახელმწიფოთა შესაბამისი გამოცდილება. აგრეთვე, აღნიშნული მიმართულებით არსებულ ქართულ სასამართლო პრაქტიკაში მიღებული გადაწყვეტილებები საჭიროებს კრიტიკულ გააზრებას, პრობლემების იდენტიფიცირებასა და მათი გადაწყვეტის გზების შემუშავებას. წინამდებარე კვლევის მიზანიც სწორედ ზემოთ ხსენებულ სამართლის წყაროებზე დაყრდნობით, მეუღლეთა თანასაკუთრების განკარგვის პრობლემური საკითხების წარმოჩენა და გადაწყვეტაა.
