ანოტაცია

დემოკრატიულ საზოგადოებაში ადამიანის უფლებები დაცული და გარანტირებულია კონსტიტუციური წესრიგით და შესაბამისი მართლმსაჯულების სისტემით. ამავე დროს ადამიანის უფლებების დაცვის უზრუნველსაყოფად მნიშვნელოვანი ფუნქცია ენიჭება მართლმსაჯულების ალტერნატიულ ან/და კვაზი - სასამართლო სისტემებს. ამდაგვარ ერთ-ერთ ალტერნატიულ ინსტიტუტად საჯარო სამართალში ომბუდსმენი მიიჩნევა.

წინამდებარე სტატია არის პირველი მცდელობა  ქართულ სამეცნიერო ლიტერატურაში, საერთაშორისო სტანდარტების, სხვა ქვეყნებისა და საქართველოს სახალხო დამცველის მაგალითზე, განხილული იქნას ომბუდსმენის ინსტიტუტის მანდატის თავისებურებები, რომელიც საჯარო დაწესებულებების მიერ ადმინისტრირების განხორციელებისას მიღებული გადაწყვეტილებების კანონიერების შესწავლას და მას როგორც უფლების დაცვის ალტერნატიულ ინსტიტუტს უკავშირდება.
