საქართველოს სამოქალაქო კოდექსის ამოქმედებიდან ორ ათეულ წელზე ცოტა მეტი გავიდა. თუმცა, მოქალაქეები მაინც ნაკლებად არიან ინფორმირებულები ქონების საკუთრებაში გადაცემის ხელშეკრულებათა სამართლებრივი ბუნების შესახებ. ამდენად, სამისდღეშიო რჩენის ხელშეკრულების ნაცვლად ისინი ხშირად მიმართავენ ჩუქების ან ნასყიდობის ხელშეკრულების გამოყენებას. ეს უკანასკნელი კი ვერ უზრუნველყოფს სახელშეკრულებო ურთიერთობის მონაწილე სუბიექტთა მიერ დასახული მიზნის მიღწევას და მჩუქებლისათვის თუ გამყიდველისათვის ნაკლებად ქმნის სამართლებრივი დაცვის გარანტიებს.
წინამდებარე სტატიაში განხილულია ხელშეკრულების თავისუფლება როგორც კერძოსამართლებრივი ურთიერთობის მნიშვნელოვანი მონაპოვარი, ხელშეკრულების თავისუფლების პრინციპის შესაბამისობა ევროპული ვალდებულებითი სამართლის პრინციპებთან, ხელშეკრულების ალეატორული ხასიათი, მისი განსაკუთრებული იურიდიული ბუნება, ხელშეკრულების სამართლებრივი მახასიათებლები, ხელშეკრულების ფორმა, ხელშეკრულების ფიდუციალური და გრძელვადიანი ვალდებულებითი ხასიათი და სხვა.
