წარმოდგენილი სტატია შეეხება იუნესკოს 1960 წლის 14 დეკემბრის „განათლებაში დისკრიმინაციის წინააღმდეგ“ კონვენციის (UNESCO, ქ. პარიზი) იმპლემენტაციას საქართველოს კანონმდებლობაში. წინამდებარე სტატია მოიცავს ზემოხსენებული კონვენციის საქართველოს კანონმდებლობაში იმპლემენტაციის ზოგად ასპექტებს. მასში განხილულია თუ რა არის განათლების დისკრიმინაცია, რა ტიპის დისკრიმინაცია არსებობს და რა სახის დისკრიმინაციას შეიძლება ჰქონდეს ადგილი საგანმანათლებლო დაწესებულებებში. კონვენციის იმპლემენტაცია საქართველოს კანონმდებლობაში მიზანშეწონილია განვიხილოთ განათლების ხელმისაწვდომობის, განათლების დაფინანსების, ინკლუზიური განათლების, ეროვნული უმცირესობების განათლების უფლებებისა და რელიგიური და პოლიტიკური ნიშნით დისკრიმინაციის აკრძალვის თვალსაზრისით. წარმოდგენილი კვლევის მიზანია, არსებული საკანონმდებლო აქტების შესაბამისობის დადგენა კონვენციით ნაკისრ ვალდებულებებთან. კვლევაში მიმოხილული საკითხები, ძირითადად, ინფორმაციულია, ვინაიდან ხდება არსებული საკანონმდებლო აქტების ანალიზი და შედარება კონვენციით ნაკის ვალდებულებებთან. შესაბამისად, სტატიაში საუბარია: ა) განათლების ხელმისაწვდომობაზე. მასში განხილულია, ის სამართლებრივი აქტები, რომელშიც პოვა ასახვა ზემოაღნიშნული კონვენციის დებულებებმა. ამავე ნაწილში საუბარია 2014 წლის 2 მაისს (ქუთაისი, № 2391-IIს) მიღებულ დისკრიმინაციის ყველა ფორმის აღმოფხვრის შესახებნ საქართველოს კანონზე, რომელიც, თავის მხრივ, აწესრიგებს განათლების სფეროში დისკრიმინაციის აღმოფხვრისა და განათლების ხელმისაწვდომობის საკითხს; ბ) განათლების დაფინანსებაზე. ვინაიდან ზოგად განათლებას კანონმდებლობით დადგენილი წესით სრულად აფინანსებს სახელმწიფო და მოქალაქეებს უფლება აქვთ კანონით დადგენილი წესით სახელმწიფოს დაფინანსებით მიიღონ პროფესიული და უმაღლესი განათლება, მოცემულ ნაწილში განხილულია განათლების სამივე საფეხურის დაფინანსების საკითხი; გ) ინკლუზიური განათლების ხელმისაწვდომობაზე. ყველა მოქალაქისთვის განათლების ხელმისაწვდომობის პრინციპისა და დისკრიმინაციის ყველა ფორმის დაუშვებლობიდან გამომდინარე, სახელმწიფოსთვის მნიშვნელოვან გამოწვევას წარმოადგენს ინკლუზიური სწავლების პრინციპის დანერგვა. ამდენად, სტატიაში აგრეთვე განხილულია საგანმანათლებლო დაწესებულებებში ინკლუზიური განათლების ხელმისაწვდომობა; დ) ეროვნული უმცირესობების განათლების უფლებებაზე. საერთაშორისო სტანდარტების შესაბამისად, საქართველო იცავს უმცირესობების ინდივიდუალურ და კოლექტიურ უფლებას და ხელს უწყობს მათ სამოქალაქო ინტეგრაციას. აღნიშნული გამოიხატება განათლების მიღების ხელმისაწვდომობაშიც; ე) რელიგიური და პოლიტიკური ნიშნით დისკრიმინაციის აკრძალვაზე. სტატიაში მოცემულია აღნიშნული საკითხის ეროვნულ დონეზე მარეგულირებელი ნორმები, რომელიც თანხვედრაში მოდის ზემოხსენებული კონვენციის მე-5 მუხლთან.
სტატიაში ასევე წარმოდგენილია დასკვნები განხილული საკითხების საქართველოს კანონმდებლობაში იმპლემენტაციასთან დაკავშირებით.
