დღესდღეობით საქართველოში არც კონსტიტუციითა და არც სხვა საკანონმდებლო აქტებით სრულყოფილად განსაზღვრული არ არის საქართველოს საელჩოებისა და სხვა დიპლომატიური წარმომადგენლობების შექმნის, მათი ხელმძღვანელების დანიშვნისა და გამოწვევის საკითხები. განსახილველი საკითხი ეხება საქართველოს პრეზიდენტისა და საქართველოს მთავრობის საზიარო უფლებამოსილებებს საგარეო წარმომადგენლობითი ფუნქციების განხორციელებისას, კერძოდ ელჩების დანიშვნა-გამოწვევის კომპეტენციების ნაწილში. ნაშრომის მიზანია, მკაფიოდ განისაზღვროს აღმასრულებელი ხელისუფლებისა და სახელმწიფოს მეთაურის კომპეტენცია საკანონმდებლო რეგულირებასთან დაკავშირებით და წარმოდგენილ იქნეს გარკვეული რეკომენდაციები, კონსტიტუციის ძირითად პრინციპებზე დაყრდნობით. ამდენად, პირველ რიგში, უნდა მოხ- დეს კონსტიტუციის ძირითადი პრინციპების ჩამოყალიბება და შემდეგ განისაზღვროს კონკრეტული კომპეტენციები. ვფიქრობთ, სახელმწიფოს მეთაური აღმასრულებელ ხელისუფლებას კი არ განეკუთვნება, არამედ არის საკავშირო ხელისუფლების წარმომადგენელი, ე.ი. ძირითადი წარმომადგენლობითი ფუნქციის განმახორციელებელი სუვერენი. აქედან გამომდინარე, შეიძლება ვისაუბროთ სახელმწიფოს მეთაურის ხელისუფლების პრიმატზე საგარეო ურთიერთობების, ქვეყნის თავდაცვისა და უსაფრთხოების საკითხებში და ასევე სახელმწიფოს უმნიშვნელოვანესი მიმართულების განსაზღვრის საკითხებში. სწორედ საგარეო ურთიერთობების ერთ-ერთი უმნიშვნელოვანესი დარგია დიპლომატიური თანამდებობის პირების თანამდებობებზე განწესება, რაც, ნაწილობრივ, კონსტიტუციით რეგულირდება, თუმცა აღნიშნული საკითხი უფრო დიდწილად მოწესრიგებულია ე.წ. დიპლომატიური სამართლისა და საერთაშორისო დიპლომატიური სამართლის ნორმებით, რაც მეტ-ნაკლებად ასევე უნდა იქნეს განხილული.
