დიფამაცია როგორც მიუღებელი შემოსავალი, საკმაოდ პრობლემური საკითხი აღმოჩნდა, რამაც მის აქტუალურობას გაუსვა ხაზი. დიფამაციის მიმართულებით სასურველი იქნებოდა უფრო მეტი ქართულენოვანი ლიტერატურა ან თუნდაც სტატიები შექმნილიყო. უცხოურ კანონმდებლობასა და ანალიტიკურ მასალაზე დაყრდნობით, შეიძლება ითქვას, რომ დიფამაციასა და ცილისწამებას შორის სხვაობა დიდია. აქვე, ისიც აღსანიშნავია, რომ ამ სხვაობის გაქრობა, დიდი ალბათობით, გამოიწვია საქართველოში ცილისწამების დეკრიმინალიზაციამ, რამაც საბოლოოდ ცილისწამება და დიფამაცია ტერმინოლოგიურად გაუტოლა ერთმანეთს.
კარგი იქნებოდა გააზრებულიყო ცილისწამების, როგორც სისხლისსამართლებრივი დანაშაულის მნიშვნელობა, რისი საქართველოში დეკრიმინალიზაციით მართალია მეტად გარანტირებული გახდა სიტყვის და გამოხატვის თავისუფლების უფლება, თუმცა აღნიშნულზე დაყრდნობით ადამიანის პატივისა და ღირსების გამტეხი ინფორმაციის გავრცელების აკრძალვის დაწესების უგულებელყოფა მიუღებელია.
სამეცნიერო სტატიის მიზანია დღესდღეობით აქტუალური და პრობლემური საკითხის, კერძოდ კი დიფამაციის როგორც მიუღებელი შემოსავლის ერთ-ერთი წინაპირობის ბუნების შესწავლა, ასევე პრობლემების გადაჭრის ავტორისეული გზების დასახვა.
წინამდებარე კვლევის საგანს წარმოადგენს დიფამაციის, როგორც მიუღებელი შემოსავლის სამართლებრივი ბუნების, დოქტრინისა და სასამართლოს პრაქტიკის შესწავლა.
ნაშრომის შექმნის პროცესი, ძირითადად, არის დოქტრინალური ტიპის, სადაც გამოყენებულია კრიმინოლოგიური კვლევის შემდეგი მეთოდები: დოკუმენტური; შედარებით სამართლებრივი; დესკრიფციული; ისტორიულ-სამართლებრივი და სისტემური.
