თანამედროვე სამყარო ყოველდღიურ ცხოვრებაში სულ უფრო ხშირად მოიხმარს ინტერნეტს. ინტერნეტის მეშვეობით ადამიანები, სხვებს შორის, აფორმებენ სამომხმარებლო ხელშეკრულებებს. ამ გარემოებამ წარმოშვა ურთიერთობების სამართლებრივ ნორმებთან მისადაგების, საჭიროების შემთხვევაში – ახალი სამართლებრივი ნორმების შემოღების საჭიროება. ინტერნეტის განვითარების კვალდაკვალ, წარმოიქმნა ხელშეკრულების ელექტრონული ფორმა, რაც მარტივი წერილობითი ფორმის ხელშეკრულების ანალოგიად მოგვევლინა. ამ ვითარებაში წარმოიშვა სამართლებრივი საკითხი: უთანაბრდება, თუ არა ელექტრონულად შეთანხმებული სამართლებრივი კატეგორია პირგასამტეხლო წერილობითს? სხვასთან ერთად, ამ საკითხზე პასუხის გაცემაც არის წარმოდგენილი სტატიის მიზანი.
