„ფაქტობრივი ქორწინება“ - ბუნება, ტერმინი, ნიშნები, სუბიექტები და ცნება

საქართველოს სამოქალაქო კოდექსის 1151-ე მუხლის თანახმად, მეუღლეთა პირად და
ქონებრივ უფლება-მოვალეობებს წარმო შობს მხოლოდ საქართველოს კანონმდებლობით
გათვალისწინებული წესით რეგისტრირებული ქორწინება. დასახელებული ნორმის სხვაგვა-
რი განმარტება ეწინააღმდეგება მის ნორმატიულ შინაარსს. მიუხედავად აღნიშნულისა, ხში-
რია ქალისა და მამაკაცის „ფაქტობრივი ქორწინების“ შემთხვევები, რაც მისი შედეგების სა-
მართლებრივი იგნორირებიდან გამომდინარე იწვევს ურთიერთობის მონაწილე პირთა სასა-
მართლო ხელისუფლების ორგანოებისადმი მიმართვიანობასა და, ამდენად, შესაბამისი დარ-
გის მკვლევართა ინტერესს. წინამდებარე კვლევის მიზანია დასახელებული სოციალური ინ-
სტიტუტის ქორწინებასთან, როგორც ყველაზე მსგავს სამართლებრივ ინსტიტუტთან შედა-
რების საფუძველზე შეფასდეს და განისაზღვროს ქორწინების გარეშე თანაცხოვრების სა-
მართლებრივი ბუნება. ამასთანავე, დადგინდეს: ურთიერთობის სრულფასოვანი ტერმინო-
ლოგიური აღნიშვნა, სოციალურ-სამართლებრივი ნიშნები, მისი სუბიექტის მახასიათებლები
და ყოველივე აღნიშნულის საფუძველზე ჩამოყალიბდეს ურთიერთობის ცნება.
