ქართული ადმინისტრაციული სამართლის ევროპეიზაცია ევროინტეგრაციის ჭრილში – წარსულის გამოცდილება და მომავლის პერსპექტივები

ქართული ადმინისტრაციული სამართლის ევროპეიზაციის პროცესი დამოუკიდებლობის პერიოდში გაჩენილი ფენომენია, რომელიც ძირითად ასოცირების შეთანხმებამდე და ასოცირების შეთანხმების შემდგომ ფაზებს მოიცავს. მიუხედავად იმი სა, რომ ასოცირების შეთანხმება საქართველოს სამართლებრივი სისტემის რეფორმის კონკრეტულ ვალდებულებებს ადგენს, მის ფარგლებში მოაზრებული სამართლის ევროპეიზაციის პროცესები უნდა განვასხვაოთ ევროკავშირის ფორმალურ საზღვრებში მიმდინარე სამართლებრივი სისტემების ევროპეიზაციის ფენომენისაგან. ეს განსხვავება, თავის მხრივ, დღის წესრიგში აყენებს ქართული ადმინისტრაციული სამართლის რეფორმის (ევროპეიზაციის) რეალურად ფუნქციონირებადი სტრატეგიის შემუშავების საჭიროებას, რომლის ფარგლებშიც გაირკვევა, თუ როგორ არის შესაძლებელი ევროპული სამართლებრივი გამოცდილების წარმატებული რეცეფცია ან ტრანსპლანტაცია ქართულ სამართლებრივ სისტემაში, რაც წინამდებარე სტატიის ძირითადი მიზანია.
